Mechanicus Insurance Services LLC ("Mechanicus," "we," "us," or "our") is committed to protecting the privacy and security of your personal information. As an insurance wholesaler, broker, and managing general agent, we collect and process personal data to provide our services. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you interact with us, including through our website, portal ("Site"), or other business activities. This policy complies with applicable laws in all 50 U.S. states, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), Virginia Consumer Data Protection Act (VCDPA), and Colorado Privacy Act (CPA).

We collect only the personal information necessary to identify your needs, provide insurance brokerage and underwriting services, process claims, manage client relationships, and enhance your experience on our Site. The types of information we may collect include:

  • Personal Identifiers: Name, company, job title, email address, phone number, mailing address, Social Security number, driver’s license number, or other government-issued IDs.

  • Financial Information: Payment details, credit history, or insurance policy details.

  • Professional Information: Employment history or business contact information.

  • Sensitive Personal Information: Health information, financial account details, or other data required for underwriting or claims processing.

  • Online Activity: IP address, browsing history, cookies, session identification numbers, or device information when you visit our Site.

  • Commercial Information: Insurance policy records, claims history, transaction types, content viewed or downloaded, or risk profiles.

  • Protected Classifications: Age, gender, or other demographic data required for insurance purposes.

  • Usage Data: Domain name, time spent on pages, methods by which our Site was found, or areas of the Site visited.

We collect this information directly from you (e.g., through forms, applications, or user registration), indirectly (e.g., through cookies or third-party partners), or from publicly available sources. Some information, such as name and contact details, is collected only if voluntarily provided during registration or transactions. We also collect aggregated data (e.g., how many times visitors click on a page) that does not identify individuals.

  • Online Forums and Social Networks: To enable participation in interactive discussions, post comments, or engage in networking activities, subject to relevant terms of use.

  • Analytics and Improvement: To personalize Site content, improve quality, track marketing campaign responsiveness, conduct usability testing, and facilitate navigation (e.g., preserving shopping cart data or avoiding duplicate data entry).

  • Event Communication: To provide information about events we host or co-sponsor, including logistics, updates, or related opportunities. Event co-sponsors may contact you post-event, subject to their privacy policies.

  • Compliance and Legal Obligations: To meet regulatory requirements, prevent fraud, enforce terms and conditions, or comply with legal processes (e.g., subpoenas).

  • Security: To detect and address anomalous activity, prevent abuse (e.g., spam), or protect our Site and users.

  • Insurance Carriers and Partners: To facilitate underwriting, policy issuance, or claims processing.

  • Service Providers: Third parties performing services like payment processing, cloud hosting, data analytics, or IT support, under strict confidentiality agreements.

  • Regulatory Authorities: To comply with legal obligations, such as reporting to state insurance departments or responding to judicial orders.

  • Affiliates: Within Mechanicus Insurance Services LLC for operational purposes.

  • Event Co-Sponsors: For events we host or co-sponsor, subject to their privacy policies.

  • Business Transfers: In connection with a merger, acquisition, or sale of assets.

  • Third-Party Advertisers: Non-personally identifiable data may be used to select audiences for advertisements, with your consent where required. Advertisers may place cookies when you interact with ads.

We do not sell your personal information for monetary compensation. However, under some U.S. state laws, sharing data for targeted advertising may be considered a “sale.” See Section 6 for opt-out options. Personal information is not shared with unrelated third parties unless we have a legal basis, such as your consent or a legal obligation. We may disclose information pursuant to judicial or government subpoenas, warrants, or orders after approximately two weeks, unless otherwise required by law.

 

4. SMS and Text Messages.

With your consent (opt-in), we may use your personal information to provide and improve our products and services through the use of SMS and text messages (“Mobile Information”), as described and limited below.  Mobile Information also includes information related to SMS registration, as well as opt-in and opt-out  communications and elections.

We may share your Mobile Information with service providers as necessary to deliver these services, but will not transfer or share such information with third parties for marketing purposes. Any information sharing that may be mentioned elsewhere in this policy does not apply to Mobile Information.

By providing your mobile telephone number and agreeing to receive SMS and text messages, you thereby consent to  receive such messages from Mechanicus Insurance Services LLC, from 803-866-4225, regarding notifications pertaining to your client’s insurance account, customer care issues, or the status of risks submitted to us to place with insurance carriers or their managing general agents, including notice of our receipt of coverage quotes from third-party insurers. Consent is not a condition of purchase. Message frequency will vary, and message and data rates may apply.

5. Your Privacy Rights

Depending on your state of residence, you may have the following rights:

  • Right to Access/Know: Request details about the personal information we collect, use, or disclose.

  • Right to Delete: Request deletion of your personal information, subject to legal exemptions (e.g., insurance record retention or contractual obligations).

  • Right to Correct: Request correction of inaccurate or outdated personal information.

  • Right to Opt-Out: Opt out of the sale or sharing of personal information for targeted advertising (where applicable).

  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

We will verify your identity (e.g., by requesting proof of identity or details about your interactions with us) and respond within the timeframes required by law (e.g., 45 days under CCPA/CPRA). We may charge a reasonable fee for providing data copies where permitted. Requests may be denied if exemptions apply (e.g., data needed for legal compliance or service delivery).

 

California-Specific Rights

If you are a California resident, you may request information about third-party disclosures by emailing contact-us@mechanicusinsurance.com with “Your California Privacy Rights” in the subject line or mailing Mechanicus Insurance Services LLC, 180 Beverly Road, White Plains, NY 10605, Attn: Privacy Administrator. Include your name, address, and preferred response method. California residents under 18 who are registered users may request removal of publicly posted content by emailing contact-us@mechanicusinsurance.com with a detailed description. Note that such requests may not ensure complete removal, and legal exemptions may apply.
